Commercial Export Terms • Incoterms 2020

1. Scope of Services & B2B Commercial Nature

These Terms and Conditions govern the access and use of the digital trade portal (eastgate.co.in, eastgateexport.com), Pocket Import Desk, and mobile applications (com.eastgate.export) operated by Eastgate Export Private Limited.

Our services are provided strictly for commercial Business-to-Business (B2B) rice procurement by licensed food importers, wholesalers, distributors, retail chains, and commercial caterers. We do not engage in domestic retail consumer sales.

2. Price Benchmarks & Fortnightly Validity

Price levels published on our Price Board (FOB Mundra Port, India) represent fortnightly (15-day) indicative benchmark ranges derived from Northern Indian mandi arrivals, milling parities, and currency exchange rates.

  • Indicative Nature: Benchmark ranges serve as market guidance and do not represent an irrevocable open offer until a Formal Proforma Invoice is executed.
  • Validity Countdown: Each benchmark is stamped with a 15-day validity period. Upon expiry, benchmark figures are automatically adjusted to reflect prevailing harvest and logistics costs.
  • Binding Contract: A legally binding price is finalized only upon mutual execution of a formal Sales Contract / Proforma Invoice with agreed payment terms.

3. Packaging Rules, MOQ & Cylinder Engraving

To guarantee consistent industrial printing and food-grade packaging standards, the following Minimum Order Quantities (MOQ) and setup policies apply:

BOPP & PP Woven Bags (Private Label)

  • MOQ: Strictly 3 containers (~78 Metric Tonnes) per single packing size due to rotogravure printing cylinder runs.
  • Cylinder Charge: One-time charge (~$1,200–$1,400 USD per design) on the initial production run only. Waived on all subsequent repeat orders.

Non-Woven Fabric & Jute Bags

  • MOQ: Accepted starting from 1 container (~26 Metric Tonnes).
  • Cylinder Charge: Zero ($0) cylinder charge. Flexible for new market testing and medium-volume private labeling.

4. Shipping Terms & Incoterms 2020

All export operations adhere strictly to the International Chamber of Commerce (ICC) Incoterms 2020 rules:

  • FOB (Free on Board - Mundra Port, India): Eastgate Export delivers the container on board the vessel nominated by the buyer at Mundra Port, clearing Indian customs and APEDA export formalities.
  • CFR / CNF (Cost and Freight): Eastgate Export pays the freight necessary to bring the goods to the named destination port. Risk passes to buyer once on board.
  • CIF (Cost, Insurance and Freight): Eastgate Export procures marine cargo insurance (covering Institute Cargo Clauses A - All Risks) with coverage of 110% of contract value.

5. Standard Payment Terms

Unless otherwise explicitly agreed in writing, shipments are executed under either:

  • Standard Commercial Advance: 30% advance deposit via telegraphic transfer (T/T) upon contract confirmation + 70% balance against original Bill of Lading (B/L) scan copy.
  • Letter of Credit: 100% Confirmed, Irrevocable Letter of Credit (L/C) at sight issued by a first-class international bank, allowing standard export documents (Commercial Invoice, Packing List, Certificate of Origin, Phytosanitary, SGS Quality & Weight Certificate).

6. Quality Inspections & Claims Policy

Every export container is subject to stringent pre-shipment quality inspection at our processing units and stuffing points by accredited independent surveyors (SGS / Eurofins / Intertek).

In the rare event of a quality or weight discrepancy upon arrival, the buyer must notify Eastgate Export within 7 calendar days of vessel discharge at the destination port, supported by an official joint inspection survey report issued by an internationally recognized surveyor (such as SGS).

7. Governing Law & Jurisdiction

These terms, contracts, and dispute resolutions shall be governed by and construed in accordance with the laws of the Republic of India. The competent courts in New Delhi, India shall have exclusive jurisdiction over any disputes arising out of or in connection with export transactions.
